Summary
- InsureShip is a licensed insurance agency. It is not the insurer. Coverage is underwritten by Navigators, a Hartford company.
- Your coverage is governed only by the insurance policy or certificate and any endorsements. The coverage terms are reproduced, unchanged, in Section 4.
- The store where you shop is not InsureShip's agent and is not an insurer.
- You can cancel shipping insurance for a full refund any time before the merchant ships your order. After shipment, the purchase is final.
- File claims at insureship.com/pages/file-claim. Filing a false claim is a crime.
- California law applies. Most disputes are resolved by individual arbitration, not class actions, and you can opt out within 30 days (Section 16). Insurance coverage disputes follow the policy.
This summary is for convenience. The full Terms below control.
1. Acceptance and eligibility
1.1 These Terms and Conditions ("Terms") are an agreement between you and Online Shipping Insurance Services, Inc., doing business as InsureShip ("InsureShip," "OSIS," "we," "us," or "our"). They apply to your use of insureship.com, the claims portal at claims.insureship.com, and any related pages, forms, tools, calculators, and communications we provide (together, the "Website"), and to the services we provide as an insurance agency in connection with shipping insurance (the "Services").
1.2 By using the Website, purchasing shipping insurance offered by InsureShip, or submitting a claim, you agree to these Terms. If you do not agree, do not use the Website or the Services.
1.3 You must be at least 18 years old, or the age of majority where you live, to enter into these Terms on your own. A parent or legal guardian may purchase coverage or submit a claim on behalf of a minor and agrees to these Terms for that minor. Eligibility for coverage is governed by the Policy. If you use the Website or Services on behalf of a business, you confirm that you are authorized to bind that business, and "you" includes that business.
1.4 Our Refund Policy and Legal Notice are part of these Terms. Our Privacy Policy explains how we handle personal information. Merchants that have a separate written agreement with InsureShip are also bound by that agreement, which controls over these Terms for the matters it covers.
2. Who we are

3. Important insurance disclosures
3.1 We are an agency, not the insurer. InsureShip is a licensed insurance agency. Shipping insurance offered through InsureShip is underwritten by Navigators, a Hartford company (the "Insurer" or "Underwriters"). InsureShip does not itself assume the insurance risk.
3.2 The policy controls coverage. Whether a loss is covered, and for how much, is governed solely by the terms, conditions, limits, deductibles, and exclusions of the applicable insurance policy or certificate of insurance and any endorsements (together, the "Policy"). No statement on the Website, in marketing, in a chat or email, by a merchant, or by any InsureShip representative changes, expands, or waives the Policy, unless it is made in a written endorsement issued under the Policy.
3.3 Availability. Coverage is not available for every shipment, product, destination, or person. Availability, eligibility, and pricing may vary by state and may change. Coverage may be temporarily unavailable in a state, including while a license renewal is under review. Coverage is offered only where InsureShip and the Insurer are authorized to offer it.
3.4 No premium, no coverage. A shipment is covered only if (a) the premium for that shipment has been charged and received, (b) the shipment is eligible under the Policy, and (c) the coverage has not been cancelled before shipment. Displaying an offer of coverage, or a checkbox, does not by itself create coverage.
3.5 Merchants are not our agents. A store or merchant that offers InsureShip coverage at checkout is not InsureShip's agent and is not an insurer. A merchant has no authority to bind coverage, change the Policy, accept or decide a claim, or make promises on behalf of InsureShip or the Insurer. InsureShip pays qualifying merchants for advertising space that connects shoppers with shipping insurance. Advertising rates depend on the store’s audience, placement and eligibility. Final rates are subject to review and agreement.
3.6 How the premium is charged. The insurance premium is charged on InsureShip's own merchant account. It may appear on your card or bank statement as a separate charge from the merchant's charge for your order.
3.7 Order of precedence. The Policy controls all questions of coverage. These Terms control your use of the Website and the Services. If these Terms and the Policy conflict on a coverage question, the Policy controls. Nothing in these Terms reduces any right you have under the Policy or under insurance laws that cannot be waived.
4. Shipping Insurance Coverage Terms
The coverage terms below are reproduced from the InsureShip shipping insurance certificate without change. They are not modified by any other part of these Terms. In this section, "OSIS" and "Online Shipping Insurance Services" mean InsureShip, and "Underwriters" means the Insurer.

Conditions
It is warranted by the insured that all parcels under this coverage will be shipped in accordance with all regulations of the carrier and amendments thereof.
The deductible, if any, shall be deducted from the amount of the claim or liability limit, whichever is less, on a "per parcel" basis and borne by the insured. The insured is responsible for (and entitled to) collecting any amount for which the carrier may be liable.
The insured must wait 20 days for domestic, 30 days for international shipments, to file for non-delivery claims. If damaged, the insured may file a notice of damage with Online Shipping Insurance Services immediately. All claims must be filed within 90 days of shipment to be honored. The insured will submit a completed Online Shipping Insurance Services claim form, copy of the original invoice to the consignee/ original invoice from the shipper, whichever is applicable, a signed and dated statement from the consignee / receiving party, proof of damage if applicable and any additional documentation requested to substantiate the loss. Coverage does not include handling fees and insurance fees. All damaged property for which payment (not repair costs), or replacement costs have been made, must, on request, be returned to the Underwriters. Failure to hold the damaged property until the claim is fully resolved will result in the claim's being denied. The insured will have one (1) year from the date of the shipment to furnish any required and/or additional documentation requested by Online Shipping Insurance Services in order for the insured to substantiate said claim. Should the insured fail to provide the required and/or additional documentation within one (1) year from the ship date, the insured's claim will be denied. Any covered loss will be promptly paid to the insured or their assignee after notice of loss or damage and the required documentation has been received and accepted by Underwriters in accordance with all terms and conditions of this coverage, unless property is replaced, at the option of the Underwriters, with like kind, function, and quality.
Upon payment for loss or damage, the Underwriters shall be subrogated to all the rights of the insured including whatever money may be recoverable. This payment excludes applicable deductible amounts corresponding to the claim settlement on account of said loss or damage from the carrier, or any of the carrier's employees or agents, or from any other person or corporation whatsoever. The insured specifically covenants and agrees to aid the company in all manners possible to aid in securing reimbursement of said loss or damage. In the event the carrier admits to fraudulent activity from the carrier's employees, the insured will take action against the carrier and not hold Online Shipping Insurance Services responsible for claims associated with said activity.
No suit, action or proceedings for the recovery of any claim under this coverage shall be sustainable in any court of law or entity unless the respective action is commenced within twelve (12) months after discovery by the insured of the issue giving rise to the claim, provided however, that said time limitation is invalid by the state law where this coverage is issued. In that case any such claim shall be void.
The insured or the Underwriters may terminate this policy at any time by giving fifteen (15) days written notice thereof, provided that such termination does not impact a shipment already in transit. Certified notice of cancellation sent to the insured at the last known address shall be deemed sufficient compliance with the conditions of this clause on the part of the Underwriters.

Concealed Damage - Allows for the discovery of loss or damage up to 15 days after final delivery. The loss is deemed to have possibly occurred during the insured transit. Discovery of loss or damage occurring 16 days or later after final delivery is deemed to have occurred while the shipment was NOT in transit, and therefore, is not covered.

5. Claims cooperation and investigation
5.1 How to file. File claims at https://insureship.com/pages/file-claim (claims portal: https://claims.insureship.com/). Claim deadlines, waiting periods, and documentation requirements are set by the Policy (see Section 4).
5.2 Your duty to cooperate. When you submit a claim, you agree to provide complete and truthful information; to provide the documents, photographs, statements, and other information we or the Insurer reasonably request; to keep damaged goods and packaging as the Policy requires; to make damaged goods available for inspection or return on request; and to cooperate with efforts to recover from the carrier or others.
5.3 Our investigation rights. To the extent permitted by law and the Policy, InsureShip and the Insurer may verify any claim. This can include contacting the merchant, the carrier, and the recipient; reviewing tracking, delivery, and order records; requesting signed statements; inspecting goods and packaging; comparing the claim with prior claims; and using fraud-prevention tools and services. A claim is not complete until all requested information has been received.
5.4 Referrals. We may report suspected insurance fraud to the Insurer, the California Department of Insurance, other regulators, and law enforcement, as permitted or required by law.
5.5 Claim decisions. Claims are evaluated and paid in accordance with the Policy. Submitting a claim does not guarantee payment. A claim payment is not a refund of premium.
6. Fraud warning
Any person who knowingly presents a false or fraudulent claim for the payment of a loss is guilty of a crime and may be subject to fines and confinement in state prison.
Other states have similar laws. Submitting false information, altered documents, or a claim for a package you received in acceptable condition may lead to denial of the claim, cancellation of coverage, recovery of any amount paid, and referral to authorities.
7. Premium payments and reversals
7.1 You authorize InsureShip to charge the premium for coverage you select to the payment method you provide at checkout.
7.2 If a premium payment for a shipment is charged back, reversed, or otherwise not honored, and the premium is not repaid, the premium for that shipment has not been paid. Whether coverage applies is then governed by the Policy and applicable law. Where the law allows, we may recover the unpaid premium, or any claim payment made on a shipment whose premium was not paid.
7.3 Please contact us at hello@insureship.com before disputing an InsureShip charge with your bank. We can usually resolve billing questions quickly. Cancellation and refund rules are in our Refund Policy.
8. Website license and prohibited uses
8.1 Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Website for your personal or internal business purposes: to learn about our Services, purchase coverage, and submit and track claims.
8.2 You agree not to:
- submit false, misleading, or incomplete information, or any fraudulent or exaggerated claim;
- impersonate any person or business, including InsureShip, a merchant, a carrier, or a claimant, or misrepresent your relationship with any of them;
- use the InsureShip name, logos, or other marks, or any confusingly similar name or domain, without our written permission;
- scrape, crawl, harvest, or copy the Website or its content by automated means, or use the content to build a competing product or data set, except for ordinary search-engine indexing that follows our robots.txt rules;
- access accounts, claims, or data that are not yours, or test, probe, or bypass any security or access control;
- introduce malware, overload the Website, or interfere with its operation;
- reverse engineer any part of the Website or our tools, except to the extent the law expressly allows despite this restriction;
- frame or mirror the Website, or present our content as your own; or

9. Intellectual property
The Website and its content, including text, graphics, logos, designs, software, calculators, and compilations, are owned by OSIS or its licensors and are protected by copyright, trademark, and other laws. "InsureShip" and the InsureShip logos are trademarks of OSIS. Except for the limited license in Section 8.1, no rights are granted to you. If you send us feedback or suggestions, we may use them without obligation to you.
10. Third-party content and comparison pages
10.1 The Website may link to or describe third-party websites, platforms, carriers, and products. We do not control them and are not responsible for their content, availability, terms, or practices. A link is not an endorsement.
10.2 Some pages compare InsureShip with other shipping insurance or package protection providers. Those pages are based on publicly available information as of the date stated on the page, describe what third parties publish about themselves, and may become outdated. They are not legal conclusions about any company and are not a promise about any third party's product. To request a correction, email hello@insureship.com.
10.3 Calculators, estimates, examples, and educational content are for general information only. They are not guarantees and are not legal, insurance, tax, or financial advice.
11. Electronic communications
11.1 You consent to receive communications from us electronically, including by email, on the Website, and through the claims portal. You agree that notices, disclosures, and other communications we send electronically satisfy any legal requirement that they be in writing, to the extent permitted by law.
11.2 Where the law requires your specific consent before an insurance document is delivered electronically, we will ask for that consent separately. You may ask for a paper copy of any required insurance document, or withdraw consent to electronic delivery, by contacting us at hello@insureship.com or 1-866-701-3654. Keep your email address current so you receive claim updates.
11.3 Calls with InsureShip may be recorded for quality, training, and claim-handling purposes. We will tell you at the start of a call if it is being recorded.
12. Privacy
Our Privacy Policy explains how we collect, use, and share personal information. To opt out of the sharing of personal information for cross-context behavioral advertising, visit https://insureship.com/pages/data-sharing-opt-out.
13. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND ALL TOOLS, CALCULATORS, ESTIMATES, AND INFORMATION PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE WEBSITE WILL BE AVAILABLE, SECURE, OR FREE OF ERRORS OR HARMFUL COMPONENTS.
NOTHING IN THIS SECTION OR IN SECTION 14 LIMITS ANY OBLIGATION OF THE INSURER UNDER THE POLICY, ANY OBLIGATION INSURESHIP OWES YOU AS A LICENSED INSURANCE AGENCY UNDER APPLICABLE LAW, OR ANY RIGHT THAT CANNOT BE WAIVED OR LIMITED UNDER APPLICABLE LAW.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, INSURESHIP, ITS AFFILIATES, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, INCOME, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF INSURESHIP AND THOSE PERSONS FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS (OTHER THAN CLAIMS FOR BENEFITS UNDER THE POLICY) WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNT YOU PAID TO INSURESHIP IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
THESE LIMITATIONS DO NOT APPLY TO (1) BENEFITS PAYABLE UNDER THE POLICY, WHICH ARE GOVERNED BY THE POLICY; (2) LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR GROSS NEGLIGENCE; (3) LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE; OR (4) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING CALIFORNIA CIVIL CODE SECTION 1668. SOME STATES DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.
15. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless InsureShip, its affiliates, the Insurer, and their respective directors, officers, employees, and agents from and against third-party claims, and related losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees), arising out of (a) your misuse of the Website or Services; (b) any false, fraudulent, or misleading claim or information you submit; (c) your violation of these Terms or of any law; or (d) your infringement of anyone else's rights. This section does not require you to indemnify us for our own negligence or misconduct.
16. Governing law and dispute resolution
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION AND WAIVES CLASS ACTIONS AND JURY TRIALS. YOU MAY OPT OUT WITHIN 30 DAYS (SECTION 16.9).
16.1 Governing law. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that this Section 16 is governed by the Federal Arbitration Act.
16.2 Agreement to arbitrate. Except as stated in Section 16.7, any dispute, claim or controversy between you and InsureShip arising out of or relating to these Terms, the Website, the Services, premium charges, cancellations, refunds or our communications with you (a "Dispute") will be resolved by binding individual arbitration, not in court.
16.3 Try to resolve it first. Before starting arbitration, the party with the Dispute must send a written notice describing it and the relief requested. Send notices to InsureShip at hello@insureship.com or 3211 Cahuenga Blvd W, 2nd Floor, Los Angeles, CA 90068. If the Dispute is not resolved within 60 days after the notice is received, either party may start arbitration.
16.4 Rules and location. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single arbitrator. It will take place in the county where you live, or by phone, video or written submissions if you prefer. The arbitrator may award the same individual relief a court could award, but only to you individually.
16.5 Fees. For a Dispute you start, you will pay no more than the filing fee you would pay to file the claim in court, and InsureShip will pay the remaining AAA filing, administration and arbitrator fees, unless the arbitrator finds the claim frivolous or brought for an improper purpose. Each party pays its own attorneys’ fees unless the arbitrator awards fees under applicable law.
16.6 Class action and jury trial waiver. TO THE EXTENT PERMITTED BY LAW, YOU AND INSURESHIP AGREE THAT EACH MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED OR REPRESENTATIVE PROCEEDING, AND YOU AND INSURESHIP WAIVE ANY RIGHT TO A JURY TRIAL. If a court decides this waiver is unenforceable for a particular claim, that claim will be decided by a court under Section 16.8 and not in arbitration. Any request for public injunctive relief will be decided by a court after the individual arbitration is complete.
16.7 Exceptions. This arbitration agreement does not apply to: (a) individual claims that qualify for small claims court; (b) disputes about whether a loss is covered, or the amount payable, under the Policy, which are governed by the Policy, including its Claim Disputes provisions (see Section 4); (c) claims for injunctive relief to stop misuse of intellectual property or confidential information; or (d) any complaint you file with the California Department of Insurance or another regulator, which this section never limits.
16.8 Court venue. Any Dispute that is not arbitrated, and any dispute described in Section 16.7(b), must be brought in the state or federal courts located in Los Angeles County, California, and you and InsureShip consent to the personal jurisdiction of those courts.
16.9 30-day opt-out. You may opt out of this arbitration agreement by emailing hello@insureship.com with the subject line "Arbitration Opt-Out" within 30 days after you first accept these Terms or first purchase coverage, whichever is earlier. Include your name, the email address used at checkout and, if you have one, your order number. Opting out does not affect any other part of these Terms.
16.10 Changes and severability. If InsureShip changes this Section 16, you may reject the change by emailing us within 30 days after it is posted, and changes will not apply to a Dispute already noticed. If any part of this Section 16 other than the class action waiver is found unenforceable, the rest remains in effect. This Section 16 survives the end of your use of the Website and Services.
17. Time limits
17.1 Deadlines for filing a claim under the Policy, providing documentation, and bringing suit on a Policy claim are set by the Policy (see Section 4), as applied under applicable law. If a Policy time limit is not enforceable under applicable law, the period that law allows applies, and a claim is not void for that reason.
17.2 To the extent permitted by law, any other claim arising out of or relating to the Website or these Terms must be brought within one (1) year after the claim arises, or it is permanently barred. If applicable law does not allow this period, the shortest period the law allows applies.
18. Suspension and termination
We may suspend or end your access to the Website or the claims portal at any time if we reasonably believe you have violated these Terms, misused the Website, or submitted a fraudulent claim, or if needed for security or legal reasons. Suspension of Website access does not by itself cancel coverage for a shipment already in transit; cancellation of coverage is governed by the Policy. Sections that by their nature should continue (including Sections 6, 7, 9, and 13 through 20) survive.
19. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date and, where required by law, give additional notice. Changes apply from their effective date. Changes to these Terms do not change the coverage terms that applied to a shipment already insured; coverage for that shipment remains governed by the Policy in effect when it was insured. Your continued use of the Website after the effective date means you accept the updated Terms.
20. General terms
20.1 Severability. If any part of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted, and the rest of these Terms will remain in effect.
20.2 Entire agreement. These Terms, the Policy, and the Refund Policy and Legal Notice are the entire agreement between you and InsureShip about the Website and the Services, and they replace any prior statements about those subjects. A separate signed agreement between InsureShip and a merchant controls for the matters it covers.
20.3 Assignment. You may not assign or transfer these Terms or your rights under them without our written consent, except that a right to a claim payment may be assigned if and as the Policy allows. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, or to an affiliate.
20.4 No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later. A waiver is effective only if it is in writing and signed by an authorized InsureShip officer.
20.5 Events beyond our control. We are not responsible for delays or failures in operating the Website caused by events beyond our reasonable control. This does not affect the Insurer's obligations under the Policy.
20.6 Interpretation. Headings are for convenience only. "Including" means "including without limitation."
