Is OrderProtection.com Insurance? What Its Terms Say (2026)

OrderProtection.com describes its product in different ways on different pages. Here is each version, quoted, so you can see which one governs your order.

Back to the resource center
Quick answer: It depends which OrderProtection.com document you read. Its customer terms (last updated April 2, 2025) describe a "package protection service" and do not mention insurance. Its merchant help docs call shopper payments "premiums" that "go directly to your store." An unlisted page on its site says shipments are insured under a captive policy issued by "Order Protection Insurance Ltd." (as of October 2026).

Key takeaways

  • The customer terms, the document you agree to as a shopper, contain no mention of insurance, an insurer, a policy or a license.
  • Merchant help docs say premiums go to the store, the store is invoiced, and the store is paid the greater of its revenue share or claim reimbursements.
  • A noindexed page titled "Compliance & Insurance Captive" names "Order Protection Insurance Ltd." and says you are a loss payee, not an insured.
  • We did not find a US license number or a regulator registration for that entity on OrderProtection.com.
  • Route's lawsuit against OrderProtection.com is a trade-secrets and contract case, not a case about whether its product is insurance.

What does OrderProtection.com say about its product?

These are OrderProtection.com's own words, as of October 2026.

1. The customer terms (what shoppers agree to)

“…the package protection service (the "Service") provided by OrderProtection.com, Inc. ("OrderProtection") to consumers … of third-party retailers (each a "Brand").”— Customer Terms and Conditions, "Last Updated: April 2, 2025," orderprotection.com/legal/customer-terms-conditions
“OrderProtection is not a party to any such Order, and OrderProtection is not responsible or liable for and does not guarantee any representation, warranty or obligation of the applicable Brand to you.”— Customer Terms and Conditions, orderprotection.com

The terms cap liability at "THE LESSOR OF (I) $5,000 OR (II) THE ACTUAL AMOUNT PAID BY YOU TO THE BRAND FOR THE APPLICABLE ORDER." We found no reference to insurance, an insurer or a policy in them.

2. The merchant help docs

“Bills — the Order Protection premiums your customers paid on their orders. These funds go directly to your store. Invoices — what Order Protection charges your store on your billing cadence (daily, weekly, or monthly) to collect those premiums.”— OrderProtection.com docs, Dashboard, docs.orderprotection.com
“We issue payouts on a monthly basis, comparing: Revenue Share — Your contracted percentage of Order Protection fees generated. Claim Reimbursements — The total reimbursement amount credited to you for approved claims. You will always receive the greater of these two totals each month.”— OrderProtection.com docs, How Payouts Work, docs.orderprotection.com

3. An unlisted "Compliance & Insurance Captive" page

The page at orderprotection.com/compliance-old is titled "Compliance & Insurance Captive | OrderProtection.com" and is marked noindex, so search engines are asked not to list it. The address without "-old" returned "not found" when we checked, so this may be an older page that OrderProtection.com no longer maintains. Ask OrderProtection.com whether it is current. The page says:

“Eligible shipments are insured under a captive insurance policy issued to OrderProtection.com, Inc. by Order Protection Insurance Ltd. While you are not an insured under the Order Protection Policy, any reimbursement will be directed to you as a loss payee. Coverage may not be available in all jurisdictions and coverage is governed by the terms, conditions, limitations and exclusions set forth in the Order Protection Policy.”— orderprotection.com/compliance-old
“Backed by Deloitte and Bermuda's robust regulatory environment” … “100% owned and managed by Order Protection Insurance Ltd.”— orderprotection.com/compliance-old

We did not find a US producer license number on OrderProtection.com, or a regulator registration for Order Protection Insurance Ltd. We have not searched US or Bermuda regulator databases for that entity.

Is OrderProtection.com regulated as insurance?

Whether a product is insurance is decided by state law and regulators, based on what it does, not its label. California defines insurance as "a contract whereby one undertakes to indemnify another against loss, damage, or liability arising from a contingent or unknown event" (Cal. Ins. Code § 22). Selling insurance usually involves two licenses: authority for the insurer, and a producer license for whoever sells it (Cal. Ins. Code §§ 700, 1631).

Regulators' general consumer alerts, which name no company, say to check who stands behind the coverage:

“Legitimate shipping insurance providers will be licensed companies or producers.”— Oklahoma Insurance Commissioner Glen Mulready, November 28, 2023, oid.ok.gov

For OrderProtection.com, useful questions are: Which document governs my purchase? If a captive policy applies, in which jurisdiction is Order Protection Insurance Ltd. licensed, and who is the licensed producer in my state? See our 10 questions to ask any provider. What lawsuits involve OrderProtection.com?

Route App, Inc. v. OrderProtection.com, Inc. et al.

Allegation D. Utah No. 2:23-cv-00606, filed September 5, 2023 by Route, a competitor, under the Defend Trade Secrets Act. Defendants include OrderProtection.com, Julian Wilson, and several former Route employees. OrderProtection.com counterclaimed. This is a trade-secrets and contract dispute. It is not a case about whether OrderProtection.com's product is insurance.

Rulings so far:

  • August 13, 2024: the court denied Route's motion for a preliminary injunction.
  • December 9, 2024: the court dismissed OrderProtection.com's defamation counterclaims with prejudice and its business-disparagement counterclaim without prejudice.
  • August 24, 2026: the court denied the defendants' motion for summary judgment and granted Route's motion for partial summary judgment in part. It concluded that four individual defendants breached specific contract obligations: "Defendant Wilson breached Route's Terms and Conditions, Defendant Lefrandt breached his confidentiality obligations, Defendant Chatterley breached his confidentiality obligations and Defendant Steele breached his Noncompetition Agreement." The court said the remaining disputed breaches, causation and any damages "remain for determination by the factfinder."
