Licensing, Compliance & Trust

How InsureShip is licensed and regulated, who stands behind the coverage, and how merchants and shoppers can check whether any shipping protection product is real insurance.

Is package protection legally considered insurance?

It can be. Whether a product is insurance is decided by state law and regulators based on what it does, not what it is called. In July 2024 the National Association of Insurance Commissioners (NAIC) warned consumers about package protection and advised them to make sure the provider is licensed.

What is "fake" shipping insurance?

"Fake shipping insurance" usually refers to checkout protection that is marketed like insurance but is not sold by a licensed agency or backed by a named insurer. Warning signs include terms that say the product is not insurance, no named insurer, and claim rules set entirely by the provider.

Why should merchants care whether their shipping protection is licensed?

Merchants that offer unlicensed protection can face consumer complaints, claim disputes, regulatory scrutiny and lawsuits. Several class actions allege that pre-selected shipping protection was charged without affirmative consent. Using a licensed agency with a named insurer and an opt-in offer reduces those risks.

How do I evaluate a shipping insurance provider?

Ask: Is the seller a licensed insurance agency or insurer? Which insurer underwrites the coverage? Is there a written policy or certificate you can read? Who decides claims, and under what terms? Is the checkout offer opt-in? Then verify the license with your state's insurance department.

Do InsureShip's terms include arbitration?

Yes. Most disputes about the website and services are resolved by individual binding arbitration under the AAA Consumer Arbitration Rules, with a class action and jury trial waiver. You can opt out by emailing hello@insureship.com with the subject "Arbitration Opt-Out" within 30 days after you first accept the Terms or first purchase coverage.

Disputes about whether a loss is covered follow the policy, and complaints to the California Department of Insurance or another regulator are never limited.
